Debra Baynard was convicted by a jury of grand larceny and attempted grand larceny.
The facts are not in dispute. Baynard’s husband, Steven Baynard, was employed by I.M. Reimer Company (Reimer) as a carpet layer. Baynard and her two children, age 15 and 18, were living in Reimer’s home as a tenant at sufferance.
On February 19, 1976, Baynard and her two children left the Reimer home for what was to be a visit with relatives in Kalama, Washington. While en route to Kalama, Steven Baynard was arrested by a state trooper for driving while intoxicated. Baynard and her children were taken to the jail in Walla Walla, where Steven Baynard was incarcerated for 16 days on the DWI charge. During this period, the children were allowed to stay in the Walla Walla jail on an out-of-state warrant until the father was released.
When the children were returned to Steven Baynard on March 3, 1976, the Reimer home was locked and Steven Baynard was not there. However, upon entry into the house, the children found large amounts of cash lying on the floor. Steven Baynard’s clothing and personal belongings were in the house, and it appeared as though he had just left.
Steven Baynard was later taken to jail by the police and placed on probation. During the period of probation, Steven Baynard began missing some days of work and also missed several days of meetings with his probation officer.
While Steven Baynard was in jail and on probation, Baynard began a relationship with one Michael Lewis, a married man. In April 1976, Baynard and Lewis broke up and
